This Acceptable Use Policy (“Acceptable Use Policy” or “AUP”) establishes the rules, standards, and conditions governing access to and use of the services, products, platforms, applications, and technologies provided by Learnyst Insight Private Limited (“Learnyst,” “Company,” “we,” “our,” or “us”).
This AUP applies to all users of the Learnyst platform and related services, including but not limited to websites, mobile applications, learning management systems, APIs, communities, communication tools, integrations, cloud-hosted infrastructure, and all related products and services (collectively, the “Services”).
The purpose of this Acceptable Use Policy is to:
Protect the security, integrity, availability, reliability, and lawful operation of the Services;
Maintain a safe, respectful, secure, and compliant environment for all users;
Prevent misuse, abuse, unlawful activities, security threats, and harmful conduct;
Protect the rights, privacy, data, intellectual property, and interests of Learnyst, its customers, users, partners, and third parties; and
Ensure compliance with applicable laws, regulations, contractual obligations, and industry standards.
All users accessing or using the Services are required to use the Services responsibly, lawfully, and in a manner consistent with this Acceptable Use Policy, Learnyst’s Terms of Service, Privacy Policy, security requirements, contractual obligations, and all applicable laws and regulations.
By accessing, registering for, or using the Services, users acknowledge that they have read, understood, and agreed to comply with this Acceptable Use Policy and all related Learnyst policies and guidelines.
1. Scope
This Acceptable Use Policy applies to all individuals, organizations, and entities that access, use, interact with, administer, integrate with, or otherwise utilize the Services provided by Learnyst Insight Private Limited, including but not limited to:
Customers, subscribers, and account owners;
Educational institutions, coaching centers, enterprises, and training organizations;
Instructors, educators, creators, and content providers;
Learners, students, participants, and end users;
Administrators, moderators, and authorized representatives;
Employees, contractors, consultants, vendors, and business partners; and
Any other individual or entity accessing or using the Services in any capacity.
This Policy applies to all activities, interactions, and use of the Services, including but not limited to:
Content uploaded, created, published, transmitted, or shared through the platform;
Communications conducted using the Services;
User-generated content and educational materials;
Data processing and storage activities;
Integrations, APIs, plugins, and third-party connections;
Account administration and access management; and
Any other use of the Services, infrastructure, systems, applications, or networks operated by Learnyst.
All users are responsible for ensuring that their access to and use of the Services complies with this Acceptable Use Policy, applicable laws and regulations, contractual obligations, and all related Learnyst policies, standards, and guidelines.
2. Permitted Use
Users may access and use the Services provided by Learnyst Insight Private Limited solely for lawful, authorized, legitimate, and bona fide educational, training, business, informational, and operational purposes consistent with the intended functionality of the Services.
All use of the Services must comply with:
Applicable local, national, and international laws, regulations, and governmental requirements;
Learnyst’s Terms of Service and related agreements;
This Acceptable Use Policy;
Applicable privacy, intellectual property, cybersecurity, and data protection laws; and
Any contractual, institutional, or regulatory obligations applicable to the user’s activities.
Users are responsible for ensuring that their use of the Services does not:
Violate the rights of Learnyst or any third party;
Interfere with the security, integrity, availability, or performance of the Services;
Misuse platform functionality or infrastructure; or
Create legal, regulatory, operational, or security risks for Learnyst or other users.
Users are solely responsible and accountable for all activities conducted through their accounts or under their credentials, including activities carried out by:
Authorized users;
Employees and personnel;
Students and learners;
Contractors, consultants, and service providers; or
Any other individual or entity accessing the Services on their behalf or through their accounts.
Users must maintain appropriate safeguards to protect account credentials, access mechanisms, devices, and systems used in connection with the Services and must promptly notify Learnyst of any suspected unauthorized access, misuse, or security incident.
3. Prohibited Activities
Users shall not access, use, or interact with the Services provided by Learnyst Insight Private Limited in any manner that is unlawful, unauthorized, harmful, abusive, fraudulent, deceptive, or otherwise inconsistent with the intended purpose, security, integrity, reliability, or lawful operation of the Services.
Users are prohibited from engaging in activities that:
Violate applicable laws, regulations, contractual obligations, or third-party rights;
Compromise or attempt to compromise the confidentiality, integrity, availability, or security of the Services;
Interfere with or disrupt the operation, performance, or accessibility of the platform or infrastructure;
Cause harm to Learnyst, its users, customers, partners, systems, or networks; or
Expose Learnyst or other users to legal, regulatory, reputational, operational, or security risks.
Prohibited activities include, but are not limited to, the following:
3.1 Illegal or Unauthorized Activities
Users shall not use the Services to:
Violate any applicable local, national, or international law, regulation, ordinance, court order, governmental directive, or regulatory requirement;
Engage in fraudulent, deceptive, misleading, unlawful, or unethical activities or conduct;
Promote, facilitate, coordinate, or participate in illegal transactions, schemes, or activities;
Impersonate any individual, organization, institution, or entity, or falsely represent identity, affiliation, authorization, or credentials;
Submit false, inaccurate, or misleading information through the Services;
Circumvent, disable, interfere with, or undermine any legal, technical, operational, authentication, licensing, monitoring, or security controls implemented by Learnyst;
Access or attempt to access the Services, systems, accounts, or data without proper authorization;
Use the Services in violation of export control laws, sanctions requirements, or trade restrictions; or
Assist, encourage, or enable any third party to engage in prohibited or unlawful conduct through the Services.
Any use of the Services for unlawful, unauthorized, or prohibited purposes may result in suspension or termination of access, removal of content, reporting to relevant authorities, legal action, or other remedial measures deemed appropriate by Learnyst.
3.2 Harmful, Offensive, or Abusive Conduct
Users shall not post, upload, publish, distribute, transmit, store, display, communicate, or otherwise make available through the Services any content, material, communication, or activity that is unlawful, harmful, abusive, offensive, threatening, discriminatory, or otherwise inappropriate.
Prohibited content and conduct include, but are not limited to, content or activities that:
Are defamatory, libelous, abusive, threatening, harassing, intimidating, hateful, discriminatory, or violent;
Promote, encourage, facilitate, or engage in harassment, bullying, stalking, intimidation, exploitation, abuse, or targeted attacks against individuals or groups;
Contain sexually explicit, obscene, pornographic, exploitative, or otherwise inappropriate material;
Promote, depict, encourage, or facilitate self-harm, suicide, violence, terrorism, extremism, or other dangerous activities;
Incite unlawful conduct, public harm, civil unrest, or criminal activity;
Violate or infringe the privacy, publicity, confidentiality, intellectual property, or other legal rights of any individual or entity;
Contain false, misleading, deceptive, or manipulated information intended to cause harm or misrepresentation;
Promote hate speech or discrimination based on race, ethnicity, nationality, religion, gender, gender identity, sexual orientation, disability, age, or any other protected characteristic;
Exploit, endanger, or harm minors or vulnerable individuals in any manner; or
Are otherwise objectionable, inappropriate, harmful, unethical, or inconsistent with the intended purpose of the Services, as reasonably determined by Learnyst Insight Private Limited.
Learnyst reserves the right to review, remove, restrict, disable access to, or take enforcement action against any content, account, or activity that violates this Acceptable Use Policy or may expose Learnyst, its users, or third parties to legal, security, operational, or reputational risks.
3.3 Spam and Unsolicited Communications
Users shall not use the Services provided by Learnyst Insight Private Limited to transmit, distribute, facilitate, or engage in spam, unsolicited communications, deceptive messaging practices, or other abusive communication activities.
Prohibited activities include, but are not limited to:
Sending spam, bulk unsolicited messages, chain messages, or unauthorized promotional communications;
Conducting phishing, spoofing, impersonation, or social engineering activities designed to deceive, manipulate, or obtain unauthorized information;
Distributing or transmitting malware, ransomware, viruses, malicious code, spyware, Trojan horses, or other harmful software or technologies;
Harvesting, scraping, collecting, extracting, or obtaining user information, contact details, credentials, or personal data without proper authorization or lawful basis;
Conducting unauthorized advertising, solicitation, marketing, lead generation, or commercial promotional activities through the Services;
Using automated systems, bots, scripts, or communication tools in a manner that disrupts or abuses platform functionality or communications systems;
Manipulating platform engagement metrics, communication systems, ratings, analytics, enrollments, or user interactions through deceptive or artificial means;
Sending misleading, deceptive, fraudulent, or unauthorized notifications, alerts, or communications;
Using the Services to facilitate scams, fraudulent schemes, or unauthorized commercial activities; or
Interfering with or negatively impacting the usability, reliability, reputation, or performance of the Services or communications infrastructure.
Users must ensure that all communications conducted through the Services comply with applicable anti-spam, privacy, electronic communications, cybersecurity, and consumer protection laws and regulations.
Learnyst reserves the right to monitor, restrict, suspend, filter, remove, or block communications, accounts, or activities that violate this Acceptable Use Policy or that may compromise the security, integrity, availability, or reputation of the Services.
3.4 Security Violations
Users shall not engage in any activity that compromises, attempts to compromise, or may adversely affect the security, integrity, confidentiality, availability, reliability, or performance of the Services, systems, networks, infrastructure, data, or users of Learnyst Insight Private Limited.
Prohibited security-related activities include, but are not limited to:
Attempting to gain unauthorized access to systems, accounts, applications, databases, networks, APIs, infrastructure, or data;
Accessing, using, modifying, monitoring, or extracting information or resources without proper authorization;
Interfering with, disrupting, damaging, disabling, overloading, or compromising the Services, platform functionality, infrastructure, or connected systems;
Conducting or attempting vulnerability scanning, penetration testing, security assessments, probing, or reconnaissance activities without prior written authorization from Learnyst;
Circumventing, disabling, bypassing, or undermining authentication, authorization, encryption, monitoring, licensing, or access control mechanisms;
Introducing, uploading, transmitting, distributing, or executing viruses, malware, ransomware, spyware, Trojan horses, worms, malicious scripts, or other harmful code or technologies;
Using automated tools, bots, crawlers, scrapers, scripts, or similar technologies in a manner that negatively impacts the performance, availability, stability, or security of the Services;
Engaging in denial-of-service (DoS), distributed denial-of-service (DDoS), resource exhaustion, bandwidth abuse, or other activities intended to impair or disrupt platform operations;
Attempting to intercept, monitor, manipulate, or tamper with communications, data transmissions, or user sessions;
Exploiting vulnerabilities, misconfigurations, or security weaknesses for unauthorized purposes;
Creating or using fraudulent accounts, credentials, tokens, or access methods;
Interfering with security logging, monitoring, alerting, auditing, or incident response processes; or
Assisting, enabling, or encouraging any third party to engage in prohibited security-related conduct.
Users must immediately report any suspected vulnerabilities, unauthorized access, security weaknesses, or security incidents affecting the Services to Learnyst through authorized reporting channels.
Any unauthorized attempt to test, probe, compromise, or misuse the Services or infrastructure may result in immediate suspension or termination of access, investigation, legal action, reporting to relevant authorities, and other remedial or enforcement measures deemed appropriate by Learnyst.
3.5 Intellectual Property Violations
Users shall not upload, publish, transmit, distribute, share, reproduce, store, display, sell, license, or otherwise use any content, material, information, software, or intellectual property through the Services in a manner that infringes, misappropriates, violates, or unlawfully exploits the intellectual property or proprietary rights of any individual, organization, or third party.
Prohibited activities include, but are not limited to:
Infringing copyrights, trademarks, service marks, patents, trade secrets, database rights, moral rights, publicity rights, or other proprietary or intellectual property rights;
Violating software licenses, content usage restrictions, contractual limitations, or confidentiality obligations;
Uploading, sharing, distributing, or providing access to unauthorized copies of software, digital media, educational materials, videos, documents, assessments, or proprietary content;
Using copyrighted or proprietary materials without appropriate authorization, permission, license, or lawful basis;
Misappropriating, copying, reproducing, modifying, reverse engineering, or unlawfully exploiting third-party intellectual property or confidential information;
Removing, altering, concealing, or bypassing copyright notices, proprietary markings, digital rights management protections, or attribution requirements;
Using the Services to distribute counterfeit, pirated, unauthorized, or infringing materials; or
Assisting, encouraging, or enabling others to violate intellectual property or proprietary rights.
Users are solely responsible for ensuring that they possess and maintain all necessary rights, permissions, licenses, authorizations, and lawful bases required for any content, materials, data, or intellectual property made available, uploaded, published, distributed, or processed through the Services.
Learnyst Insight Private Limited reserves the right to investigate alleged intellectual property violations and may remove content, restrict access, suspend accounts, terminate Services, or take legal action where appropriate in response to actual or suspected infringement or unauthorized use of intellectual property.
3.6 Misuse of Educational Services
Users shall not misuse or exploit the Services provided by Learnyst Insight Private Limited in any manner that is inconsistent with legitimate educational, instructional, training, certification, or authorized business purposes.
Prohibited activities include, but are not limited to:
Engaging in academic dishonesty, cheating, examination fraud, plagiarism, impersonation during assessments, or other unethical educational practices;
Unauthorized sharing, reproduction, redistribution, resale, or disclosure of restricted educational content, course materials, assessments, recordings, certifications, or proprietary learning resources;
Manipulating, falsifying, tampering with, or attempting to alter assessments, grades, certifications, attendance records, learner progress, analytics, or educational records;
Creating, using, or facilitating fake accounts, fraudulent enrollments, impersonated identities, or unauthorized access to courses or educational programs;
Recording, copying, capturing, distributing, streaming, or publishing classes, sessions, assessments, instructor content, or learning materials without proper authorization;
Circumventing access restrictions, licensing controls, enrollment limitations, payment mechanisms, or course access protections;
Using the Services to distribute misleading educational claims, fraudulent certifications, or unauthorized credentials;
Interfering with the administration, delivery, integrity, fairness, or reliability of educational programs or assessments conducted through the Services;
Exploiting platform features for unauthorized commercial gain, content piracy, or misuse of educational resources; or
Engaging in any conduct that may undermine the integrity, trustworthiness, reputation, or lawful operation of educational services delivered through the platform.
Users are solely responsible for ensuring that their use of the Services complies with applicable academic policies, institutional requirements, intellectual property rights, contractual obligations, and applicable laws and regulations.
Learnyst reserves the right to investigate suspected misuse of educational services and may suspend access, remove content, invalidate certifications, restrict platform functionality, terminate accounts, or take other enforcement actions deemed appropriate to protect the integrity and security of the Services.
User Responsibilities
Users of the Services provided by Learnyst Insight Private Limited are responsible for ensuring that their access to and use of the Services is lawful, secure, authorized, and compliant with this Acceptable Use Policy, applicable laws, contractual obligations, and Learnyst policies and guidelines.
Users are responsible for, including but not limited to:
Maintaining the confidentiality, security, and integrity of account credentials, authentication information, access tokens, passwords, and devices used to access the Services;
Ensuring that all use of the Services is lawful, authorized, ethical, and consistent with the intended purpose of the platform;
Monitoring and managing activities conducted through their accounts, including activities performed by authorized users, employees, learners, contractors, or third parties acting on their behalf;
Implementing appropriate administrative, technical, organizational, and security safeguards to protect systems, devices, networks, and data used in connection with the Services;
Protecting accounts and systems against unauthorized access, malware, phishing, credential compromise, and other security threats;
Promptly notifying Learnyst of any suspected or actual security incidents, vulnerabilities, unauthorized access, misuse, data breaches, or violations relating to the Services;
Ensuring that content, data, communications, and materials shared through the Services comply with applicable laws, intellectual property rights, privacy obligations, and contractual commitments;
Cooperating with Learnyst in connection with investigations, security reviews, compliance activities, or enforcement actions where reasonably required; and
Complying with all applicable laws, regulations, industry standards, institutional policies, and contractual obligations related to the use of the Services.
Users remain solely responsible and liable for all content, communications, data, activities, transactions, and actions conducted, transmitted, stored, or processed through their accounts or through the use of the Services on their behalf.
Failure to comply with these responsibilities may result in suspension or termination of access to the Services, removal of content, investigation, legal action, or other remedial measures deemed appropriate by Learnyst.
5. Content Moderation and Enforcement
Learnyst Insight Private Limited reserves the right, but does not undertake any obligation, to monitor, review, assess, investigate, moderate, restrict, remove, disable access to, or take action against any content, account, activity, communication, or use of the Services that may violate this Acceptable Use Policy, applicable laws, contractual obligations, or the rights, safety, security, or interests of Learnyst, its users, customers, partners, or third parties.
Learnyst may, at its sole discretion and without prior notice where permitted by law, investigate suspected violations or inappropriate activities associated with the Services.
Enforcement actions may include, but are not limited to:
Issuing warnings, notices, or compliance requests;
Removing, restricting, disabling, or blocking access to content, materials, or communications;
Suspending, restricting, or terminating user accounts or access privileges;
Limiting or disabling access to specific features, integrations, APIs, or functionalities of the Services;
Rejecting, quarantining, filtering, or blocking suspicious or harmful activities or communications;
Preserving logs, records, or evidence for investigative, legal, compliance, or security purposes;
Reporting unlawful, abusive, fraudulent, or harmful activities to law enforcement authorities, regulators, or other appropriate third parties; and
Taking administrative, technical, operational, or legal measures necessary to protect the Services, infrastructure, users, systems, data, or legal interests of Learnyst.
Learnyst reserves the right to take immediate action, including suspension or restriction of access, where reasonably necessary to:
Prevent or mitigate security threats, fraud, abuse, or operational disruption;
Protect the confidentiality, integrity, availability, or reliability of the Services;
Comply with legal, regulatory, or contractual obligations; or
Prevent harm, liability, reputational damage, or unauthorized activities affecting Learnyst or its users.
Nothing in this Policy obligates Learnyst to actively monitor all content or user activities, and users remain solely responsible for the content, communications, and activities conducted through their accounts or through the use of the Services.
6. Reporting Violations
Users, customers, partners, and other individuals who become aware of actual or suspected violations of this Acceptable Use Policy, unlawful activities, misuse of the Services, suspicious conduct, abuse, security vulnerabilities, unauthorized access, intellectual property violations, or other harmful activities are encouraged to promptly report such matters to Learnyst Insight Private Limited.
Reports may include, but are not limited to:
Violations of this Acceptable Use Policy;
Fraudulent, deceptive, or abusive activities;
Security incidents, vulnerabilities, or threats;
Unauthorized access or misuse of accounts or systems;
Spam, phishing, malware, or harmful communications;
Intellectual property or privacy violations; or
Any conduct that may compromise the security, integrity, availability, reliability, or lawful operation of the Services.

Users are encouraged to provide sufficient details, supporting information, and relevant evidence where reasonably possible to facilitate review and investigation.
Learnyst may review, investigate, assess, and respond to reported matters in accordance with applicable laws, regulatory obligations, contractual requirements, internal policies, security procedures, and operational considerations.
Learnyst reserves the right to take appropriate administrative, technical, legal, or operational actions in response to reported violations or suspected misconduct, including content removal, access restrictions, account suspension, escalation to relevant authorities, or other remedial measures deemed necessary to protect the Services and users.
7. Third-Party Services and Integrations
The Services provided by Learnyst Insight Private Limited may integrate with, connect to, or provide access to third-party applications, platforms, websites, APIs, software, plugins, payment gateways, communication tools, analytics providers, cloud services, or other external services and technologies (“Third-Party Services”).
Such Third-Party Services may be made available for operational, educational, communication, payment, analytics, authentication, collaboration, marketing, or platform enhancement purposes.
Users acknowledge and agree that their access to or use of Third-Party Services may be subject to separate:
Terms of service;
Privacy policies;
Licensing terms;
Security requirements; and
Operational practices established by the applicable third party.
Users are solely responsible for ensuring that their use of Third-Party Services complies with:
Applicable laws, regulations, and governmental requirements;
The terms, conditions, and policies of the relevant third-party provider; and
This Acceptable Use Policy and other applicable Learnyst policies and agreements.
Learnyst does not own, control, endorse, or assume responsibility for:
The availability, functionality, security, reliability, or performance of Third-Party Services;
The content, accuracy, legality, or practices of third parties;
The collection, processing, storage, disclosure, or protection of information by third-party providers; or
Any loss, damages, liabilities, or issues arising from the use of Third-Party Services or integrations.
Users access and use Third-Party Services at their own discretion and risk. Learnyst encourages users to independently review the applicable terms, privacy practices, and security measures of any Third-Party Services before enabling integrations or sharing information through such services.
8. Reservation of Rights
Learnyst Insight Private Limited reserves all rights necessary to protect the security, integrity, availability, reliability, lawful operation, and legitimate interests of the Services, its users, customers, infrastructure, systems, intellectual property, and business operations.
Learnyst reserves the right, at its sole discretion and without limitation, to:
Investigate any actual, suspected, or potential violation of this Acceptable Use Policy, applicable laws, contractual obligations, or platform security requirements;
Monitor, review, analyze, preserve, or disclose information, content, logs, communications, or account activities where reasonably necessary for security, compliance, operational, legal, or investigative purposes;
Restrict, suspend, terminate, or limit access to the Services, accounts, content, integrations, or functionalities;
Remove, disable, block, or refuse content, communications, or activities that may violate this Policy or create legal, operational, security, or reputational risks;
Implement technical, administrative, legal, or operational safeguards to prevent misuse, abuse, fraud, unauthorized access, or security threats; and
Take any remedial or enforcement action deemed necessary to protect Learnyst, its users, infrastructure, systems, partners, or third parties.
Learnyst may cooperate with law enforcement agencies, regulatory authorities, courts, governmental bodies, cybersecurity organizations, or other authorized entities in connection with:
Investigations relating to unlawful, fraudulent, abusive, or prohibited activities;
Legal processes, subpoenas, court orders, or governmental requests;
Security incidents, cyber threats, or compliance obligations; and
Enforcement actions relating to violations of applicable laws, regulations, contractual requirements, or this Acceptable Use Policy.
Where permitted by applicable law, Learnyst may disclose relevant information, records, logs, account details, or other materials necessary to comply with legal obligations, protect rights and security interests, or support lawful investigations and enforcement activities.
Nothing in this Acceptable Use Policy limits any legal rights, remedies, protections, or enforcement measures available to Learnyst under applicable laws, regulations, or contractual agreements.
9. Changes to this Acceptable Use Policy
Learnyst Insight Private Limited reserves the right to modify, revise, update, or replace this Acceptable Use Policy from time to time to reflect changes in:
Applicable laws, regulations, regulatory guidance, or legal requirements;
Platform features, functionalities, technologies, or Services;
Security practices, cybersecurity standards, or operational requirements;
Business operations, compliance obligations, or risk management practices; and
Industry standards, technological developments, or organizational needs.
Any updated or revised version of this Acceptable Use Policy will be published through appropriate communication channels, including publication on the Learnyst website, platform, or related Services, together with the updated “Effective Date” or “Last Updated” date.
Where required by applicable law or where changes materially affect users’ rights or obligations, Learnyst may provide additional notice through email communications, platform notifications, announcements, or other reasonable means.
Users are encouraged to review this Acceptable Use Policy periodically to remain informed about their responsibilities and Learnyst’s platform governance, security, and compliance practices.
Continued access to or use of the Services following the effective date of any revised or updated Acceptable Use Policy constitutes acknowledgment and acceptance of the updated terms, to the extent permitted under applicable law.
